Every trademark application and registration has a three-digit status code in TSDR. These codes show where your mark stands right now — pending examination, published for opposition, registered, or abandoned.
Status 630 means your trademark application is in the USPTO queue and has not yet been assigned to an examining attorney. This is normal shortly after filing. Examination typically begins within three to four months, though timing varies.
Status 638 means your application has been assigned to a USPTO examining attorney who is reviewing it against federal law and existing marks. The first office action or approval usually follows within a few months.
Status 640 means the examining attorney has prepared a non-final Office Action but it has not been mailed or e-mailed yet. The action should appear in TSDR soon, and a response deadline will start once it is issued.
Status 641 means the USPTO mailed a non-final Office Action identifying issues with your application. You typically have three months to respond with arguments, amendments, or evidence. Missing the deadline can abandon the application.
Status 645 means the USPTO mailed a final refusal maintaining at least one objection to your application. You can respond, appeal to the Trademark Trial and Appeal Board, or allow the application to abandon.
Status 680 means the examining attorney approved your mark for publication in the USPTO Official Gazette. Publication for opposition usually follows within weeks, opening a 30-day window for third parties to oppose.
Status 686 means your mark is published in the USPTO Official Gazette and in the 30-day opposition period. If no opposition is filed, prosecution typically continues toward registration or a Notice of Allowance.
Status 688 means a Notice of Allowance was issued. For intent-to-use applications, you must file a Statement of Use with specimens or request an extension before the deadline — usually six months from the notice date.
Status 700 means the trademark is registered and active on the Principal Register. You have nationwide rights for the listed goods and services and may use ®. Section 8 maintenance is due between years five and six.
Status 701 means the registration is active and the first Section 8 declaration of continued use was accepted. The next major deadline is the combined Section 8 and Section 9 filing at the 10-year anniversary.
Status 702 means the registration is active, Section 8 was accepted, and a Section 15 declaration of incontestability was also accepted. Incontestability strengthens your rights by limiting certain challenges after five years of continuous use.
Status 703 means Section 8 was accepted and a Section 15 incontestability declaration is pending USPTO review. The registration remains active while Section 15 is processed.
Status 704 applies to Madrid Protocol extensions of protection in the U.S. Section 71 (similar to Section 8) showing continued use was accepted. The U.S. extension remains active.
Status 705 means a Madrid-based U.S. registration has accepted Section 71 maintenance and Section 15 incontestability. The U.S. extension is active with strengthened rights.
Status 710 means the registration was cancelled because a required Section 8 declaration of continued use was not filed within the deadline (including any grace period). The federal registration is no longer active.
Status 800 means the registration was renewed after acceptable combined Section 8 and Section 9 filings. The mark remains registered for another 10-year term with active federal protection.
Status 730 means you filed the first six-month extension to delay filing a Statement of Use after a Notice of Allowance. You must file a Statement of Use or another extension before the new deadline.
Status 731 means the second six-month extension to file a Statement of Use was granted. File a Statement of Use or the next extension before the deadline expires.
Status 732 means the third six-month extension to file a Statement of Use was granted. You are past the midpoint of available extension time — plan SOU filing carefully.
Status 733 means the fourth six-month extension was granted. Only one extension typically remains before you must file a Statement of Use or risk abandonment.
Status 734 means the fifth and typically final extension to file a Statement of Use was granted. You must file an acceptable Statement of Use before this last extension expires or the application will abandon.
These status codes mean the trademark application is abandoned and no longer pending. Common reasons include missing an Office Action response (600), filing without a valid basis (602), express abandonment by the applicant (604), or failure to respond to an examiner's inquiry (618). Revival may be possible in limited circumstances.
